The close of 2006 saw DARE ending on a great note, whilst the UK market remained as strong as ever - new large systems were supplied to Portuguese distributor Perdigao Audio and to Singaporean distributor LDS.

DARE to fight Trade Mark nfringement

DARE Professional Audio today announced that they were about to embark on a path that many UK and American entertainment technology based companies have up to this point avoided, and that is to “Cleanse” there brand of all imitations, Trade Mark and Copyright infringements. Managing Director and founder Sammy DeHavilland today said, “As an Ex Vice Chairman of PLASA I am more aware than most of the problems that this will entail, but in contrast I am also aware of how it can be achieved successfully. We have spent nearly two decades establishing DARE as a brand and it is devastating to see fraudulent companies emerge in exactly the same market sector using the same name, whether through nativity or for fraudulent purposes, it does not matter – the responsibility lies with the perpetrator under British law. The same rules can apply to anyone selling the products, and our mission statement is to instruct the market place accordingly, we will be contacting every trader we identify, and making them aware of our Trade Marks the law and the long history of our company. We feel that this is not just about protecting our rights, but also educating the market place, which they can then choose to ignore at there own peril. Over the last 6 months I have discussed the matter with trade associations, the Patents office, and various government bodies including The DTI, Trading standards and Health and Safety. The opinion of these organisations is that a trader who is prepared to “Pass off” is almost certain to be breaking the law at many other levels, The overall conclusion made, is if we involve all of these people we not only protect our brand, but also drive these people out of business permanently, which will protect the entire industry – this is our aim” Lighting and Sound International – July 2006 Do you know a case of someone using our name? Have you brought a product with the name DARE on it, and feel it’s not an original? You may be able to seek recourse with the seller, if you are a re-seller and you have stock of anything you may feel is not 100% genuine, contact us with the serial number and we will be able to instruct you accordingly. Do not buy any stock that you feel is not genuine DARE product, we WILL be seeking recourse over the next three months and this will mean taking possession of goods that have been identified as breaching the “Passing off” laws and seeking compensation. Trading Standards have also instructed us that they will be looking for other infringements of CE, WEEE, RoHS and COSHH etc.

Clive and Toby Kinton of Meteor Electronics, during the recent PLASA Show in London. It was announced during another successful exhibition that Meteor will become the exclusive distributor for all DARE Pro Audio products. Paul Dunkley sales director of DARE said “ We have established a brilliant working relationship with Meteor since there inception, and are very excited by the opportunities the agreement offers, whist it also frees up our own personal to concentrate on developing the DARE product range”

Meteor will provide more effective sales support for our customers, whilst system engineering and technical support will still be handled directly by DARE
